Follows Schedule 1-A (Form 1040); tax saving from the IRS brackets and standard deduction (Rev. Proc. 2024-40, 2025-32). Sources: IRC §224, Treasury final rule TD 10044 (April 13, 2026). Federal income tax only; Social Security, Medicare and state income tax still apply. Rules checked October 19, 2026.

You can deduct up to $25,000 of qualified tips per return for tax years 2025 to 2028, if your job is on the Treasury list, reduced by $100 per $1,000 of income over $150,000 ($300,000 joint).

What makes a tip qualified

Three tests, all from IRC 224 and the final Treasury rule (TD 10044):

Tips earned in a specified service trade or business, such as health, law, accounting or performing arts, do not qualify when that is your employer's business (IRC 224(d)(2)(B)).

How the deduction is worked out

  1. Add up your qualified tips for the year. For 2025, employees use W-2 box 7 and tips reported on Form 4137. From 2026 the W-2 shows reported cash tips in box 12, code TP and your Treasury occupation code in box 14b.
  2. Cap the total at $25,000. The cap is the same for single and joint returns (TD 10044).
  3. Subtract $100 for each full $1,000 of modified AGI over $150,000 ($300,000 joint); a partial $1,000 rounds down (Schedule 1-A).

Example: a restaurant server with $18,000 of tips and $52,000 of income deducts the full $18,000. In the 12% bracket that is about $2,160 less federal income tax. A hairdresser with $9,000 of tips in the 10% bracket saves about $900.

The eight occupation groups

Beverage and food service; entertainment and events; hospitality and guest services; home services such as plumbers, electricians and cleaners; personal services such as tutors, nannies and pet caretakers; personal appearance and wellness such as barbers and hairdressers; recreation and instruction; and transportation and delivery, including rideshare drivers, goods delivery and home movers. The full list with its official codes is in the calculator.

Tips and overtime together

If you earn both, you can claim both deductions; tips are not counted as overtime (IRC 225(c)(2)). Work out the overtime side on the no tax on overtime calculator. This page covers federal income tax only; state income tax and payroll taxes are unchanged. Sources and test cases: test cases.

Frequently asked questions

How much is the no tax on tips deduction?

Up to $25,000 of qualified tips a year for tax years 2025 to 2028, reduced by $100 for every full $1,000 of modified AGI over $150,000 ($300,000 joint). The $25,000 limit is per return: a married couple filing jointly also gets $25,000, not $50,000.

Which jobs qualify for no tax on tips?

Only occupations on the Treasury list of jobs that customarily received tips on or before December 31, 2024. The final rule (TD 10044, April 13, 2026) lists 71 occupations in eight groups, from wait staff and hairdressers to delivery drivers and home movers.

Do card tips count, or only cash?

Both. Tips paid in cash or charged to a card count, as long as the customer paid voluntarily, chose the amount and did not negotiate it (IRC 224(d)). Automatic service charges added to the bill do not count.

Are tips tax free now?

No. Qualified tips are deducted from federal taxable income. They are still subject to Social Security and Medicare, and to state income tax unless your state follows the federal rule.

Can married couples claim it?

Only on a joint return (IRC 224(f)). Each spouse who received tips needs a Social Security number valid for work. The cap stays at $25,000 for the return.

Where are my tips on my W-2?

For 2026 and later, employers report the cash tips you reported to them in box 12 with code TP, and your Treasury tipped occupation code (a 3-digit TTOC such as 102 for wait staff) in box 14b. For 2025, use box 7 and any tips reported on Form 4137.

Do I have to report my tips to claim it?

Yes. Only tips included on a W-2, a Form 1099 or your own Form 4137 can be deducted (Treasury final rule TD 10044, section 1.224-1). Tips you never reported do not count.

Can self-employed workers claim it?

Yes, for tips earned in a listed occupation in your own business, but not more than the net profit from that business (Schedule 1-A, Part II, line 5). The specified service trade rule still applies.

Are the tip regulations final?

Yes. Treasury published final regulations on April 13, 2026. They apply to tax years beginning after December 31, 2024, so they cover your 2025 return.
